Flamingo Email ("we" or "us") provides a service you may use to create and send emails to a list of email addresses you provide, in accordance with the terms described below. All recipients must agree to receive your email messages. People giving you their email address for this purpose is sufficient permission. You may not send "spam", i.e. unsolicited email. There is no fee to create an account on this service or send emails to a list of 100 or fewer email addresses. Otherwise the fee for this service is $29.95 per month, for up to 2,500 email addresses and any number of emails sent as often as you like. Pricing for larger lists is slightly less per address, contact us for details. You agree to let us charge your credit card the appropriate amount once per month, for the month that follows. You may not use the service for anything illegal, use it to offer or solicit anything illegal, or create material that in our sole opinion is offensive or sexually explicit. The service is provided on an "as is, as available" basis. We reserve the right to restrict access to the service without notice, for any reason, at any time. We are not liable for, and you agree to hold us harmless for, any harm or damages arising from or related to you using the service, and for your inability to use or access the service. Either party may cancel this agreement at any time, with or without notice, with or without cause. There will be no refund for a partial month of service. We may change these terms at any time in any way, at our sole discretion, without liability to us, or prior notice, by posting the new terms on our web site. By continuing to use the service after such posting you are expressing your agreement to the new terms. These terms shall be construed in accordance with the laws of the state of Massachusetts, and the parties consent to bring any action related to these terms in a court located in the state of Massachusetts. These terms constitute the entire agreement between you and us regarding use of this service, superceding all previous written or verbal agreements.
